My Loved One Just Passed Away – What Next?

Losing a loved one is a difficult and emotional time and knowing what steps to take next can often feel overwhelming. Here’s a guide to help navigate what to do after someone’s passing.

1.     Notify any Necessary Parties

You may want to notify the deceased’s close family members and friends, any government agencies and relevant financial institutions of their passing.

2.     Arrange for Funeral Services

It is important to work with the funeral home to ensure that necessary arrangements are made in a way that honours the deceased’s wishes. Often the deceased’s Will may provide insight as to their preferred funeral arrangements.

3.     Locate the Deceased’s Will

The Will outlines the deceased’s wishes regarding their estate. It is important to identify the executor, the beneficiaries, and the assets and liabilities that form part of the estate.

4.     Obtain the Death Certificate

A formal death certificate from the Registry of Births, Deaths and Marriages is a crucial document, as it allows for estate administration to begin.  Generally, the funeral director will obtain this document following the funeral.

5.     Apply for Probate

If you are the executor, it is recommended to apply for probate. Probate is a document issued by the Supreme Court that confirms the validity of the deceased’s last will. Many financial institutions and government agencies require probate before they release assets.

6.     Take Care of Yourself

Managing an estate can be a complex and emotional process. It is easy to feel overwhelmed during this time. At McNamara Law, we can ease the burden by handling the estate administration for you, allowing you to grieve without additional stress.
