The process of selling property in Queensland has now changed. On 1 August 2025, the Seller Disclosure Scheme commenced operation. Sellers of real property (with some limited exceptions) are now obliged to provide Buyers with a Form 2 Seller Disclosure Notice along with supporting prescribed certificates before a Buyer signs a Contract of Sale, otherwise, pursuant to their rights under the Property Law Act 2023 (Qld) the Buyer may be entitled to terminate the contract of sale at any time up until settlement.
While the form seems simple to complete, this can be deceptive. The questions may seem easy enough to answer on the face of it, but they can be more complex than first glance would suggest. An understanding of the law behind the Seller Disclosure Scheme and the rules surrounding completing Form 2 and delivering it to the Buyer is essential to ensure complete and correct disclosure is made.
