Why Verifying Your Identity is Essential in Queensland Property Transactions: A Guide for Buyers and Sellers

All solicitors or conveyancers who assist clients with the conveyance of land transactions in Queensland are required by legislation to verify the identity of their clients to a certain standard.

Your solicitor or conveyancer will ask you to produce identification that meets this standard before they will sign any transfer of land documentation on your behalf.

Whilst it might seem onerous to have to comply with this request, the purpose of carrying out the verification of identity process is to reduce the risk of identity fraud and the registration of fraudulent land transactions in Queensland.

Put simply, it is for your protection. If you are considering buying or selling a property, think about what ID you have and take steps to have all required documents before you enter into a contract.

A Driver’s Licence and Passport are required for complete identification.  If you are not the holder of a Passport, then you may produce instead a Medicare Card and Birth Certificate in addition to your Driver’s Licence.  If you have been married or your name has otherwise changed since birth, you will need to produce a certificate to evidence this also.

Birth Extracts are no longer considered acceptable forms of ID in Queensland.  If you do not hold a full Birth Certificate, you should apply to the Registry of Births, Deaths & Marriages for a full Birth Certificate as soon as practicable.
